When Your Business Needs More Than Its Liability Limits

Every liability policy has a ceiling. For most days, that ceiling is plenty. But a single serious accident involving a company vehicle, a severe injury at a job site, or a claim involving several people at once can reach it faster than many business owners expect. A commercial umbrella policy is designed for the moment an underlying policy runs out.

What an Umbrella Sits On Top Of

Underlying policy How the umbrella helps
General liability Adds protection above your per-occurrence and aggregate limits
Commercial auto Extends coverage after a serious crash exhausts auto liability
Employer’s liability Adds protection above employer’s liability, which in Ohio typically comes from stop gap coverage

A Quick Ohio Note

Because Ohio workers’ comp runs through a state fund that doesn’t include employer’s liability, many umbrella carriers want to see stop gap coverage in place underneath. Without it, the umbrella may not respond the way you’d expect to certain employee injury lawsuits.

Umbrella vs. Excess: Not Quite the Same

Excess liability generally follows the terms of the policy beneath it, simply adding more limit. Umbrella liability can sometimes go further, offering protection for certain claims the underlying policy doesn’t address, usually subject to a self-insured retention. The wording matters, so it’s worth asking which you have.

  • Pay workers’ comp benefits themselves
  • Typically cover professional errors, which call for professional liability
